A

lan Fisch is one of the nation’s most successful intellectual property trial lawyers, having won trials around the country. He only works with those that share his burning desire to achieve justice.

Alan has achieved justice for plaintiffs and defendants. On the defense side, Alan has prevailed in patent jury trials in the Eastern District of Texas four times — more than any other national trial lawyer. On the plaintiff side, Alan's signature victories include jury trial wins against the world's largest software company, Microsoft Corporation, which was the eighth largest jury verdict in federal court that year and the then-largest patent infringement jury award in Eastern District of Virginia history. They also include a jury trial win against the world's largest electronics company, Samsung Electronics, which resulted in the largest award of fees in Eastern District of Texas history.

As a result of these and other cases, Alan has led litigations in federal courts in Arkansas, California, Connecticut, Delaware, District of Columbia, Florida, Illinois, Iowa, Maryland, Massachusetts, Minnesota, Mississippi, Missouri, New Jersey, New York, Oklahoma, Pennsylvania, Tennessee, Texas, Vermont, Virginia, Washington, West Virginia, and Wisconsin, as well as multiple state courts.

Alan remains a regular victor at the appellate level, too. He's won nine cases that he's argued before the United States Court of Appeals for the Federal Circuit. These wins have been on behalf of: Amazon.com, Blackhawk Network, Comdata Network, Costco Wholesale, Gap Inc., Pier 1 Imports, Stored Value Systems, and Thomas & Betts. Few intellectual property attorneys can claim Alan's jury trial and appellate successes.

The legal press has hailed Alan as a standout performer of the American intellectual property bar. Benchmark Litigation identified Alan as "an emerging IP legend." The IAM 1000 described Alan as a "swashbuckling litigator" who is "never afraid to take on the hardest case." Chambers called Alan a "truly exceptional litigator" and "a go-to for the most complex patent litigation cases." Law360 selected Alan as one of the 10 most admired intellectual property lawyers in the United States. Lawdragon selected Alan as one of "The Leading 500 Lawyers in America." Washingtonian selected Alan as one of the top 30 lawyers of the 80,000 practicing in the Washington DC-area. Patexia's data analytics determined that Alan is one of the ten best performing patent litigators in the nation, out of the 12,780 patent litigators evaluated. His victories have earned the American Lawyer's "Litigator of the Week" honor and Law360's "Legal Lions" accolade. Alan is also a staple in listings from Best Lawyers, Expert Guides, The Legal 500, and Super Lawyers.

"We remain committed to the vigorous pursuit of justice, in all its forms," says Mr. Fisch.

Alan's contribution to intellectual property law extends beyond just his cases. His scholarly writings have been quoted by the United States Supreme Court, the United States Court of Appeals for the Federal Circuit, other court filings, learned treatises, and over 100 law review articles. Alan's articles have appeared in publications of the law schools at Columbia, Cornell, Harvard, Tulane, and the University of Pennsylvania.

Alan is also a sought-after commentator on intellectual property protection and litigation. The press has covered or quoted him over 250 times. Some of the media outlets that have covered and quoted Alan include Barron’s, Bloomberg, BusinessWeek, Financial Times (U.K.), Fortune, The Globe and Mail (Canada), International Herald Tribune (France), The New York Times, USA Today, Variety, The Wall Street Journal and The Washington Post. Additionally, Alan has appeared in prominent publications dedicated to covering the legal community, including The American Lawyer, Corporate Counsel, Inside Counsel, Law360, The National Law Journal, and The Recorder.

Before opening his firm in 2012, Alan was a partner and on the Executive Committee at Kaye Scholer LLP (now Arnold & Porter Kaye Scholer LLP) and a partner and on the Partnership Committee at Howrey LLP. The perspective that Alan gained working in leadership roles at those firms enabled him to craft an elite boutique exclusively focused on intellectual property trial and appellate work. Since opening its doors, Fisch Sigler LLP has established a national presence.

Alan began his law career at the United States Patent and Trademark Office as a Patent Examiner, where he learned the patent craft from the inside. Before attending law school, Alan was a software design engineer at Texas Instruments, where he developed system-level software and published six technical papers.
